What was on the agenda
FACT: The posted agenda opened with “CALL TO ORDER AND INTRODUCTION OF NEW MEMBERS,” followed by mid-cycle elections for chair and vice-chair, necessary because the elected chair had been removed three weeks earlier. Then: a public hearing and action on an application from Shaddock Homes to rezone, replat, and develop 220 Redbird Lane (“The Gates at Westworth Village”) from single-family SF-A to a gated-community Planned Development with SF-B underlying zoning, plus review of the Kings Branch drainage study for the Shady Oaks site plan.
FACT: To be precise about what this rezoning is and isn’t: 220 Redbird Lane is a Shaddock Homes project. It is not the Kite Farm / Trinity Terrace project; no application under that name has appeared on any posted agenda. This was, however, the first rezoning vote taken by the commission as reconstituted after the removals.
What happened
FACT: The commission recommended approval of The Gates application. We know this from the city’s own August 11 council agenda, which schedules a public hearing and final council action on “the Planning and Zoning Commissions recommendation to approve” the application.
FACT: That morning, the demand letter delivered to the city had asked that the commission, as presently constituted, refrain from taking up any substantive rezoning matter until the July 14 removals are cured, and put the city on notice that actions taken by the commission are subject to challenge as products of a voidable act. The commission proceeded anyway.
